This is a final draft prepared for review by qualified counsel before publication. It is not legal advice.
1. What this Service is for
The Service is a private, adults-only tool for creating sexually explicit images and video of fictional characters, and of real adults who have consented to it. It is not a publishing platform, a social network, or a marketplace.
Explicit sexual content between consenting adults is the Service's intended purpose and is permitted. The prohibitions below are not matters of taste; each exists because the content is unlawful, harms an identifiable person, or would end our ability to operate.
2. Absolutely prohibited
The following will result in immediate removal, account termination, forfeiture of unused credits, and where applicable a report to law enforcement:
- Minors. Any depiction of a person under 18, or who appears to be under 18, in any sexual or sexualized context. This includes AI-generated, animated, and stylized depictions, "aged-up" versions of minor characters, and any attempt to produce a youthful-appearing subject in sexual content. There is no artistic, fictional, or satirical exception.
- Non-consensual depictions of real people. Sexual content depicting an identifiable real person who has not given specific, informed consent — including partners, former partners, acquaintances, colleagues, and strangers.
- Public figures. Sexual content depicting celebrities, politicians, influencers, or any other person of public prominence, regardless of any claimed consent.
- Sexual violence. Depictions of rape, coercion, drugging, abduction, torture, mutilation, or any sexual act presented as non-consensual.
- Incest, bestiality, and necrophilia.
- Content that sexualizes a real tragedy, crime, or identifiable victim.
- Content created to harass, extort, defame, blackmail, or threaten any person.
3. Rules for real-person references
You may create content depicting a real adult only where all of the following are true:
- the person is at least 18 years old;
- they have given you specific, informed, freely given consent to the creation of sexually explicit material depicting their likeness;
- that consent has not been withdrawn;
- you can produce evidence of that consent if we ask.
Consent to be photographed is not consent to sexual depiction. Consent given for one purpose is not consent for another. Consent from a person who is intoxicated, coerced, or dependent on you is not valid consent.
You make an express attestation each time you rely on this section, and we record it. A false attestation is a material breach of the Terms and may be unlawful.
The depicted person may withdraw consent and request removal at any time under our Content Removal and Non-Consensual Imagery Policy, and we will act on their request without needing your agreement.
4. Age-ambiguous content
Because AI models can render adults who appear younger than intended, we enforce a conservative margin. Prompts that combine sexual content with youth signifiers — school settings, children's clothing or toys, explicit references to a young age, diminutive framing, or terms commonly used to evade age screening — are refused even where the stated age is adult.
Every generated image is assessed by an automated age-appearance check before delivery. Where the result is uncertain, we refuse. You will occasionally see a lawful request refused for this reason; the credits are returned. We accept that cost deliberately.
5. How we enforce this
Prompt screening before generation; automated screening of every uploaded reference image; automated screening of every generated output before it is stored or delivered; human review of reports and escalations; and audit logging of enforcement actions.
Circumventing these systems — through coded language, obfuscated prompts, incremental prompting toward prohibited content, or altered reference images — is itself a breach, independent of whether the attempt succeeded.
Automated screening is imperfect. Its failure to block something does not make that thing permitted; you remain responsible for what you request.
6. Consequences
Depending on severity and history: a refused request; removal of content; removal of a character or identity model; suspension; or permanent termination.
For prohibited content involving minors or non-consenting people, termination is immediate, unused credits are forfeited, no refund is due, and we preserve and report records as required by law.
7. Reporting
Anyone may report content or conduct at noiretta.com/report or by emailing [email protected]. If content depicts you without your consent, use the faster route in our Content Removal and Non-Consensual Imagery Policy.
We review every report and act on credible ones. Reports concerning apparent minors are prioritised above all other work.
