This is a final draft prepared for review by qualified counsel before publication. The 48-hour removal commitment below is drafted to meet the US TAKE IT DOWN Act; counsel must confirm the final obligations and timelines applicable to this Service.
1. Who this is for
This policy is for anyone who believes that content depicting their likeness has been created or stored using the Service without their consent. You do not need to be a user, hold an account, pay a fee, or instruct a lawyer.
If you are in immediate danger, contact your local emergency services first.
In the United States, free confidential support is available from the Cyber Civil Rights Initiative Crisis Helpline at 1-844-878-2274, and takedown assistance from StopNCII.org. [Counsel/owner to confirm the appropriate support resources to list for each market served.]
2. How to make a request
Email [email protected] with the subject line "Content Removal Request", or use the report form at noiretta.com/report.
Please include:
- a statement that you are the person depicted, or that you are authorised to act for them;
- enough information for us to identify the content — a link, a screenshot, an account name, or a description of where and when you saw it;
- a reference photograph of yourself, so that we can match the likeness (we use this only to assess your request and delete it afterwards);
- a way to contact you;
- a statement, made in good faith, that you did not consent to the creation of this content, or that you have withdrawn any consent previously given.
You do not need to provide government identification to make a request. If we cannot verify a request without it, we will tell you why and offer alternatives. We will never publish your request or pass your identity to the uploading user.
3. What we do, and how fast
Intimate imagery: where a request concerns non-consensual intimate imagery — including AI-generated or "deepfake" sexual depictions of an identifiable person — we will remove the content, and disable any identity model trained on that person's likeness, within 48 hours of receiving a valid request, and we will make reasonable efforts to identify and remove known copies.
Other likeness requests: where a request concerns non-intimate content depicting you, we will respond within 10 business days.
Interim measures: where a request appears credible on its face, we may disable access to the content immediately while we assess it. We would rather briefly restrict lawful content than leave unlawful content available.
Suspected minors: content reasonably believed to depict a minor is removed immediately, the account is terminated, and the matter is reported to NCMEC and law enforcement as required by law. No counter-notice process applies, and the content is not restored.
4. What happens to the account
Where we remove content because it depicted a person who did not consent, we act against the responsible account. Depending on severity and history this may include a warning, removal of the character and any identity model, suspension, or permanent termination with forfeiture of unused credits.
A user who provided a false consent attestation has materially breached our Terms of Service, and we may preserve and disclose records of that attestation to the depicted person's legal representatives or to law enforcement, as permitted or required by law.
5. Withdrawing consent you previously gave
If you previously consented to someone creating content of your likeness and you no longer do, you may withdraw that consent at any time by contacting [email protected]. We treat a withdrawal the same as a removal request: the content and any identity model are removed, and future generation of your likeness is blocked.
Withdrawal does not require you to explain your reasons.
6. Appeals
If your content was removed and you believe that was a mistake, you may appeal to [email protected] within 30 days. We will have the appeal reviewed by someone who was not involved in the original decision and respond within 10 business days.
There is no appeal for content removed as suspected child sexual abuse material.
7. Preservation and transparency
We retain records of removal requests and the action taken, for the period necessary to comply with law and to establish or defend legal claims, even where the underlying content has been deleted.
